SMS TERMS OF SERVICE
These Terms of Service ("Terms") govern your participation in the text message notification program (the "Program") operated by [LYONS & HOHL] ("Company," "we," "us," or "our"). By opting in to the Program, you agree to these Terms.
1. Program Description
The Program is used by [LYONS & HOHL] to send informational text messages to our employees. Messages may include:
• Work schedules, shift changes, and shift availability
• Office, store, or facility closures, including weather-related closures
• Safety alerts and emergency notifications
• Company announcements, events, and meeting reminders
• Human resources, payroll, and benefits reminders
The Program is not used to send marketing or promotional messages.
2. Eligibility and Consent
The Program is available to current employees of [LYONS & HOHL]. You may enroll by completing and signing our written SMS Opt-In Consent Form. By opting in, you confirm that you are the account holder or authorized user of the mobile number you provided and that you consent to receive recurring automated text messages from [LYONS & HOHL] at that number.
Participation is voluntary. Consent to receive text messages is not a condition of employment. Employees who do not opt in will continue to receive company communications through other channels.
3. Message Frequency
Message frequency varies based on company needs, up to approximately 8 messages per month. Additional messages may be sent during emergencies or urgent situations.
4. Message and Data Rates
Message and data rates may apply. Any charges are billed by and payable to your mobile service provider according to your plan. Please contact your wireless carrier for details about your plan.
5. How to Opt Out
You may cancel at any time by replying STOP to any message. After you send STOP, you will receive one final message confirming that you have been unsubscribed, and you will receive no further text messages from the Program unless you opt in again.

7. Changing Your Mobile Number
If you change or deactivate your mobile number, please notify James promptly so we can update our records and avoid sending messages to a number that no longer belongs to you.
8. Carrier Disclaimer
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is not guaranteed and may be affected by factors outside our control, including network coverage and your device settings. Do not rely solely on text messages for time-sensitive or emergency information.
9. Supported Carriers
The Program is supported by major U.S. wireless carriers. Carrier support may change without notice.
10. Privacy
Your information is handled in accordance with our Privacy Policy, available below.
11. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted at this location with a new effective date. Continued participation in the Program after changes are posted means you accept the updated Terms.

This Privacy Policy explains how LYONS & HOHL ("Company," "we," "us," or "our") collects, uses, and protects information in connection with our employee text message notification program (the "Program").

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are not shared with any third parties.
We may share your information only with service providers that help us operate the Program (such as our text messaging platform), who are permitted to use it solely to deliver messages on our behalf, or where required by law.
We do not sell, rent, or trade your personal information.
4. Data Security
We use reasonable administrative, technical, and physical safeguards to protect your information. Signed paper consent forms are stored securely and access is limited to authorized personnel.
5. Data Retention
We keep your information for as long as you participate in the Program and afterward for as long as needed to maintain consent records and meet legal or recordkeeping requirements.

• Reply STOP to any message to opt out at any time.
• Reply HELP to any message for assistance.
• Contact James to update your mobile number or ask about the information we hold about you.
7. Changes to This Policy
